KICK OUT CLAUSE (ALSO REFERRED TO AS THE RIGHT OF FIRST REFUSAL): A contractual article that gives sellers the ability to continue marketing a house if the offer received contains contingencies or conditions. One of the most common contingencies is that the buyers must sell their current home. A kick out clause allows the seller to "kick out" a buyer with contingencies (after a certain period of time) if a better offer comes around.
